Kataba Terms of Service

This Terms of Service agreement ("Agreement") is between Zanago LLC. ("Zanago," "we," or "us") and the individual or entity accessing or using the Kataba Services ("Customer," "you," or "your"). By using the Kataba Services, you agree to be bound by the terms of this Agreement. If you do not agree, you may not use the Kataba Services.

Account Creation

To use the Kataba Services, you must create an account. You must be at least 18 years of age to create an account. When creating an account, you will be asked to provide certain information, including your name, email address, and property address. You are responsible for maintaining the accuracy and security of your account information.

Kataba Services

​

The Kataba Services provide a platform for homeowners to track, store, and manage information about their homes. This includes features such as:

• Data Storage: Securely store information about your home's repairs, maintenance, warranties, appliances, manuals, and other important documentation.

• AI-Powered Insights: Receive data-driven suggestions and recommendations from Kataba to help you proactively maintain your home.

User Responsibilities

• Data Accuracy: You are responsible for the accuracy and completeness of all information you provide to the Kataba Services.

• Appropriate Use: You agree to use the Kataba Services only for their intended purposes and in a lawful manner. You will not use the Services to post or transmit any harmful, fraudulent, illegal, or unauthorized content.

• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Intellectual Property

• Kataba Ownership: The Kataba Services, including the software, website, design, logos, trademarks, and all other content, are the intellectual property of Zanago or its licensors. You may not use Kataba's intellectual property without express written permission.

• User Data: You retain ownership of the information and data you input into the Kataba Services. By using the Services, you grant Kataba a non-exclusive, worldwide, royalty-free license to use, modify, and reproduce your data for the purposes of providing, improving, and promoting the Kataba Services.

Warranties & Disclaimers

THE KATABA SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." ZANAGO LLC. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KATABA DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION OR CONTENT ON OR PROVIDED THROUGH THE KATABA SERVICES. KATABA IS NOT RESPONSIBLE FOR ANY ERRORS, OMISSIONS, OR FOR THE RESULTS OBTAINED FROM THE USE OF THE KATABA SERVICES.
 

Limitation of Liability
 

IN NO EVENT SHALL ZANAGO LLC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY:
 

• ERRORS, MISTAKES, OR INACCURACIES WITHIN THE KATABA SERVICES

• PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM USE OF THE KATABA SERVICES

• UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN

• ANY INTERRUPTION OF THE KATABA SERVICES

• LOSS OF PROFITS OR REVENUE DUE TO RELIANCE ON INFORMATION OR SUGGESTIONS FROM THE KATABA SERVICES
   

THESE LIMITATIONS OF LIABILITY APPLY REGARDLESS OF THE LEGAL THEORY OF LIABILITY AND EVEN IF ZANAGO LLC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN SOME JURISDICTIONS, LIMITATIONS OF LIABILITY ARE NOT PERMITTED. IN SUCH JURISDICTIONS, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Zanago respects your privacy and is committed to protecting your personal information. Our Privacy Policy, located at below, describes in detail how we collect, use, share, and protect your personal information. By using the Kataba Services, you consent to the data practices described in our Privacy Policy.

Termination

​

• Termination by You: You may terminate your Kataba account at any time by following the instructions provided within the Kataba Services or by contacting Kataba customer support.

• Termination by Kataba: Kataba may terminate or suspend your account at any time, without notice, if we reasonably believe you have violated this Agreement or if your use of the Kataba Services poses a security risk. Upon termination, your right to use the Kataba Services will cease immediately.
   

Changes to Terms of Service

Zanago reserves the right to modify this Agreement at any time. We will notify you of any material changes by email, through a notification within the Kataba Services, or by other reasonable means. Your continued use of the Kataba Services after the effective date of any changes will constitute your acceptance of the updated Agreement. If you do not agree to the updated Agreement, you may terminate your account as outlined in the Termination section.

 

Governing Law

This Agreement and any disputes arising out of or related to this Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without giving effect to any conflicts of law principles.
 

Dispute Resolution

​

• Initial Negotiation: The parties agree to first attempt to resolve any dispute arising out of or relating to this Agreement through good-faith informal negotiations.

• Mediation: If a dispute cannot be resolved through informal negotiations within 30 days of written notice by either party, the parties shall submit the dispute to mediation with a mutually agreed-upon mediator in Kansas City, Missouri. The costs of mediation shall be shared equally by the parties.

• Other Remedies: If a dispute remains unresolved after mediation, either party may pursue any other legal remedies available under this Agreement or applicable law.
   

Subscription Terms

Zanago offers various subscription plans to access the Kataba Services. The specific features and pricing associated with each plan are presented on the Kataba pricing page [kataba.xyz/pricing] or within the Kataba Services.​

• Paid Plans: Kataba offers paid subscription plans with various features and benefits. [Insert descriptions of paid plans and associated pricing]

• Billing: Monthly or annual subscription fees will be billed to your chosen payment method on a recurring basis, as selected during your account setup.

• Renewal: Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.

• Cancellation: You may cancel your paid subscription at any time by following the instructions within your Kataba account settings or by contacting Kataba customer support.

• Refunds: At Zanago, we strive to provide the best possible experience with Kataba. We understand that circumstances may change, and we want to be transparent about our refund policy.

General Refund Policy:

• Digital Products: Due to the nature of digital products, all sales of Kataba are final. We do not offer refunds or exchanges for change of mind or dissatisfaction with the product.

• Exceptions

  • Technical Issues: If you encounter technical issues that prevent you from accessing or using the Kataba, we are committed to resolving the issue promptly. If we are unable to resolve the issue within a reasonable timeframe, we may offer a refund at our discretion.

  • Misrepresentation: If you believe Kataba was misrepresented in our marketing or promotional materials, please get in touch with our customer support team. We will review your case and may offer a refund if we determine that the Kataba does not meet the advertised claims.

• Changes to Subscription Plans: Kataba reserves the right to change the features or pricing of any subscription plan at any time. You will be notified in advance of any significant changes.
   

Third-Party Integrations
 

Kataba may integrate with third-party applications, websites, or services ("Third-Party Integrations") to provide you with additional features, functionality, or access to related services. Examples of Third-Party Integrations might include:
 

• Smart Home Devices: Connecting with smart home systems for appliance data or control.

• Data Providers: Integrating with services that provide home value estimates or repair cost information.

• Use of Third-Party Integrations: Your use of any Third-Party Integrations is entirely optional. When you enable a Third-Party Integration, you may be required to create an account with the third-party provider and agree to their separate terms of service and privacy policy.

• Data Sharing: Enabling a Third-Party Integration may involve Kataba sharing relevant data from your Kataba account with the third-party provider, in accordance with our Privacy Policy.

• Zanago's Responsibility: Zanago is not responsible for the content, security, or practices of any Third-Party Integrations. Your use of Third-Party Integrations is solely at your own risk.
   

Severability

If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be struck and replaced with an enforceable provision that most closely reflects the intent of the original provision. The remaining provisions of this Agreement shall continue in full force and effect.

Notices

​

• Notices from Zanago LLC: Zanago may provide you with notices regarding this Agreement or the Kataba Services by email, regular mail, postings within the Kataba Services, or other reasonable means.

• Notices from You: You must send notices to Zanago  related to Kataba Services via the contact methods provided in the "Contact Information" section below.

This Agreement, together with the Privacy Policy and any other policies or terms referenced herein, constitutes the entire agreement between you and Zanago LLC. regarding the Kataba Services, and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Kataba.
